Entry Conditions 

 

General 

  1. By participating in the Somewhere New/ 7 Feelings Prize Promotion (Promotion), you will be deemed to have: (a) accepted these terms and conditions; and (b) expressly consented to our use of your personal information under the Privacy Act, Spam Act and other related communication and legislation for marketing by the promoter.

  1. The Promotion commences on the 14 July 2023 and closes on the 15 August 2023 at 5.00 PM (AEDT) (Promotional Period). 
  1. Entry is open to Australian residents only, who are over 18 years of age. 

 

How to Enter 

  1. To enter this Promotion during the Promotional Period, you must enter online at https://www.visitnsw.com/win-somewhere-new-competition and must select your preferred prize package. 
  1. Participants in this promotion are limited to one entry only.  
  1. Your entry must include your name, address, email, telephone number and any other information so requested.  
  1. This is a game of chance and skill plays no part. The Promoter’s decision is final and no correspondence will be entered into with entrants. 
  1. All entries, once submitted, become the property of the Promoter. 
  1. The Promoter reserves the right to verify the validity of entries and to disqualify any entry that is not in accordance with these Terms and Conditions.   
  1. Incomplete, ineligible or incomprehensible entries will be deemed invalid. 

 

Eligibility 

  1. Employees of the Promoter and its Related Bodies Corporate (as this term is defined in the Corporations Act) and such employees’ immediate family members are not eligible to enter. 
  1. To protect the integrity of the Promotion, the Promoter reserves the right, at its sole discretion, to verify, at any time (including after the closing of the Promotion) the validity of all entries (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits invalid, incomplete, indecipherable, or illegible entries or tampers with the entry process or uses any automated entry software or any other mechanical or electronic means to submit repeated entries. 

 

Cheating, abuse and disorderly behaviour

  1. Any Entrant may be disqualified from this Promotion at the discretion of the Promoter for any failure to comply with these Terms and Conditions or cheating in any way such as: 
  1.  Using any cheats, hacks or other third party "helper" applications or “bots” to simulate human interaction; or 
  1.  Exploiting the application in any way or using the application in any way that circumvents the purpose and conditions of the Promotion. 
  1.  Abusive behaviour, including any use of harassing, negative or profane language in Entrant submissions will not be tolerated and will also constitute grounds for immediate disqualification. 

Judging 

16. After the Promoter notifies the Prize Winners, all future correspondence will then be between the Prize Winners and the Promoter. 

17. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any Entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms and Conditions. 

18. The Promoter reserves the right to disallow any entry and/or refuse to award a Prize where false or misleading details have been given by the Entrant. The Promoter also reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this Promotion. The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. 

 

Draws and Prizes 

19. Seven (7) lists will be provided with each entrants prize preference. An entrant can only enter once and have a chance to win one of the seven prizes. One winner will be randomly drawn from each list for each of the seven (7) prizes. The prizes will be drawn in order of value, from the highest valued prize package to the lowest valued prize. Only one winner can be awarded a prize from each category.

21.The winner will be selected by means of a random draw from all entries received. The draw will be conducted, in the presence of an independent witness on 18 August 2023 at 11.00 AM (AEDT) at Telads Australia Pty Ltd operations data centre 190 Burnley St, Richmond VIC 3121. The winner will be notified in writing on the 18 August 2023 and published at https://www.visitnsw.com/win-somewhere-new-competition/terms-of-use for a minimum period of 28 days. 

22.Due to travel package offers, a draw for any unclaimed prizes will take place at 11am (AEDT), subject to any directions from a regulatory authority on 20 of October 2023 at Telads Australia Pty Ltd operations data centre 190 Burnley St, Richmond VIC 3121. Any winner will be notified in writing on the same day as the re-draw date and published on https://www.visitnsw.com/win-somewhere-new-competition/terms-of-use for a minimum period of 28 days.  

23.The prize values are correct at time of printing and the Promoter accepts no responsibility for any subsequent variation in the prize value.  

24.If any prize (or part of any prize) is unavailable, the Promoter reserves the right to substitute the prize (or part of the prize) with a prize of equal value or specification, subject to any written directions given by the appropriate State or Territory Lottery Departments. No responsibility or liability is accepted for any variation in the value of the prizes. All prize values are in Australian dollars.  

25.The Prize Winner and their guests are responsible for any other incidental expenses as a result of using this Prize (including but not limited to meals, transfers, transport, spending money, accommodation and other experiences and attractions visited whilst in Sydney, insurance, bonds, taxes and travel expenses).  

26.The Promoter is not liable for any employment leave arrangements or arrangements for dependant family members i.e. annual leave payments, babysitting, carer arrangements.  

27.The Prize is subject to the conditions printed on the tickets and conditions of entry including dress code.  

28.You agree to comply with any reasonable directions of the venue. 

29.The Prize Winners and their guests must conduct themselves in a responsible, respectful and professional manner and comply with the conditions of the ticket and venue. 

30.The Prize will be provided to the Prize Winner as agreed between the Promoter and the Prize Winner. 

31.The Prize is non-transferable, non-refundable, non-exchangeable, non-replaceable and non-redeemable for cash. The Prize cannot be used to purchase gift certificates or lay-buys nor can they be re-sold. The Prize must be taken as offered in (Annex A). No modifications or exchanges will be possible. The Promoter accepts no responsibility for any variation in the value, performance or availability of any Prize. 

 

Personal Information and Privacy 

32.The Promoter will collect information (including Personal Information) from all entries and use it for the purposes of the Promotion and for its purposes. Entrants consent to the Promoter disclosing information, including Personal Information, to third parties for the purposes of the Promotion. All Personal Information provided by Entrants will be held by the Promoter in accordance with Privacy legislation and the Promoter’s Privacy Policy which is available at https://www.sydney.com/privacy. 

33.By submitting an entry, Entrants agree to their entry being made available for public viewing.  Entrants acknowledge and agree that the Promoter may at any time, in its absolute discretion, remove, modify or not display entries submitted for this Promotion. This includes (without limitation) any entry which (in the sole opinion of the Promoter) is defamatory, contrary to public standards of decency or otherwise judged to be inappropriate or offensive.   

      1. The Promoter is not responsible or liable in any manner for any content or materials posted in relation to this Promotion. 

35.By accepting the Prize, the Prize Winners and their guests consent to the Promoter using their details for promotional purposes.  

36.The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify the Promotion. 

37.The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as a Prize. The Promoter is not liable for any loss suffered or sustained, to people or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by it, or its agents, in connection with the supply, or arrangement for supply, of any goods or services connected with this Promotion.  

38.The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any Entrants or Prize Winners and their guests (including but not limited to indirect or consequential loss), or for any personal injury (including death) suffered or sustained as a result of taking any Prize, except for any liability that cannot be excluded by law. 

39.If this Promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the Promotion or to disqualify any individual who has tampered with the entry process.  

40.Under Privacy law, Entrants may access Personal Information that the Promoter holds about them and seek correction of that information at any time. If Entrants no longer want the Promoter to notify them of initiatives that the Promoter considers may be of interest to them, they may notify the Promoter by email: info@dnsw.com.au. If Entrants choose this option, the Promoter will destroy any Personal Information that it holds about them. 41.Your entry will be posted on Facebook and Instagram via the sharing platform Pixsta. 

 

42.The details contained in your entry are protected by security safeguards as detailed in the Promoter's Privacy Policy, which is available on the promoter’s website at https://www.destinationnsw.com.au/. Personal information will only be used in accordance with the Promoter’s Privacy Policy. The Promoter will also provide you with an option to opt out of receipt of such communications. You should direct any request to access, update or correct information to the Promoter.

44.The Promoter may, for an indefinite period, unless otherwise advised, use your personal information (such as name, age, mobile phone number, email address) and any other information provided to the Promoter pursuant to this Promotion without remuneration or compensation to you for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning you and promoting its business and related companies.  

 

Limitation of Liability  

46.The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as part of the Promotion. To the extent permitted by law, the Promoter is not liable for any loss (including indirect and consequential loss) suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again. 

47.Subject to the approval of the relevant State and Territory Lottery Departments, the Promoter may: 

  1. modify or suspend the Promotion if all entrants participating in the Promotion until that point are notified of the changes to these Conditions of Entry, upon notification of any such changes, the affected entrants may terminate their participation in the Promotion without any liability to the entrant; or  
  1. terminate or cancel the Promotion. 

The Promoter will not be liable for any modification, suspension, termination or cancellation.   

 

48.Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 

 

Exclusion of liability 

  1. By registering for this Promotion each Entrant, Prize Winner and their guests assumes sole liability for any personal injury and/or damage to property caused or claimed to have been caused to them as a result of or in connection with participating in this Promotion. 
  1. These Terms and Conditions do not affect, and are not intended to affect, any rights or remedies a consumer might have which cannot be excluded under applicable consumer protection laws.  

Governing law and jurisdiction 

  1. These Terms and Conditions are governed by the laws of NSW, Australia and the parties submit to the non-exclusive jurisdiction of the courts of NSW for the resolution of any dispute, difference, controversy or claim arising in connection with these Terms and Conditions and/or this Promotion.

Silver City Tours 

Based on availability of the tour and Ibis Styles Broken Hill at time of booking.  

 

Booking dates: 2023 Departures: 4 Sept, 18 Sept, 2 Oct, 16 Oct, 30 Oct, 13 Nov, and 18 March 2024 only.  

 

Booking 

Confirmed Booking - Your booking of a journey is confirmed when: (1) you have made the booking, complete with all information we require and we have sent you a Booking Confirmation. 

 

Inclusions - All goods and services that are included in your journey are as listed in the brochure and the website as at the date of booking. 

 

Special Requirements - Passengers must notify us of any special requirements (for example diet) at the time the booking is made. We will advise all third parties such as hotels and attractions of these requirements and will endeavour to ensure they are met. However, we cannot guarantee that all special requirements will be met in all instances. 

 

Travel Insurance - Silver City Tours strongly recommends passengers take out travel insurance to cover any unforeseen circumstances. 

 

On-Board with Silver City Tours 

No smoking / Vaping Policy - Our vehicles are all entirely smoke free in accordance with relevant state and territory government regulations. Passengers are not to smoke (including e-cigarettes) while on board. 

 

Luggage (4WD Tours only) - Luggage is restricted to one medium size soft travel bag, weighing no more than 15kg, plus one piece of hand luggage weighing no more than 3kg. Hard frame suitcases are not suitable and will only be carried at the driver’s discretion. We would greatly appreciate if you could consider this when packing. 

 

Seat Allocations - there are no seat allocations on board Silver City Tours’ vehicles, we operate on a rotation system to ensure passengers enjoy different seating positions whilst on tour. 

 

Health 

Vaccination Policy - here are no current restrictions, however this could change due to Government mandates 

 

Fitness - These tours are at a more relaxed pace. You don’t have to worry about doing anything physically demanding unless you want to. The tour is primarily coach travel but the day tours may have content that requires disembarking vessels/vehicles with stairs and/or embankments to which you have to do unaided 

 

Mobility - Passengers are required to have a reasonable level of mobility to be able to board and alight the coach unaided. Due to space restrictions aboard our coaches, we are unable to accommodate passengers who require the use of wheelchairs but walkers can be stored. Our vehicles are not equipped with wheelchair ramps or lifters. Passengers requiring physical or mental assistance must be accompanied by a companion who is willing and capable of providing such assistance. 

 

Enjoyment - Silver City Tours will take all reasonable steps to provide an enjoyable tour. However, no liability will be accepted for any loss of enjoyment experienced by passengers due to circumstances which are out of our control. 

 

Safety – Passengers accept that tours include participation in Recreational Services and Recreational Activities which may involve certain risks and dangers beyond the control of Silver City Tours. Such activities containing risks include but are not limited to: bush walking and travelling in remote undeveloped locations. The passenger acknowledges that all Recreational Services and Recreational Activities in connection with the journey are undertaken of the passenger’s own free will and at the passenger’s own risk. Passengers will not be permitted to continue on tours when in the opinion of the Silver City Tours Guide/Driver, the passenger’s conduct or condition is placing their own or the safety of other passengers at risk, or is adversely affecting the enjoyment of other passengers; for whatever cause. 

 

Travelling to remote areas - Passengers accept that some itineraries include visits to and overnight stays in remote areas located some distance from hospitals, medical centres or other forms of professional medical facilities. This is particularly the case for Silver City Tours Corner Country Tours which travel through remote country for days on end. 

 

Amendments and cancellations 

Guest amendments - Subject to availability, you may amend your booking. If an alternate date is unavailable or unsuitable and you cannot travel on the original date your booking will be subject to our standard cancellation terms detailed below 

 

Amendments for bookings are permitted up to 30 days prior to departure. Amendment fees from any third parties who are supplying components of the booking (for example hotels or attractions) may apply. 

  • Transferring to a new calendar years will attract the applicable tour fare for that season.  
  • Amendment fees from any third parties who are suppling components of the booking (for example hotels or attractions) may apply.

Guest cancellations - If you cancel your booking with us, you must notify us in writing or by email to sctbhq@iinet.net.au and pay a cancellation fee in the amount set out below.

Passengers are advised that the service provided by Silver City Tours is for the booking and packaging of goods and services provided by other operators such as hotels, motels, attractions, cruise lines, airlines and other transportation companies. Silver City Tours will not be liable for any loss, damage, omission or act of negligence or otherwise committed by these operators, their assignees or agents. 

 

Silver City Tours is unable to guarantee exact arrival or departure times and is not liable for any failure to make connections with any other service or guarantee the operation of any particular service.

PAYMENTS & SECURITY BONDS  

1. A booking fee/bond of $900 is payable within seven (7) days of making a booking, to ensure preferred dates of travel.  

2. The full hire fee is to be paid a minimum of one (1) week prior to arrival. Payment four (4) weeks prior to arrival for peak period and special event bookings is required. Non-payment by this date will be considered a cancellation and the conditions detailed under the “Cancellations” section of these conditions of hire will apply.  

3. The bond is in addition to the hire charge and will be refunded less fuel and LP gas charges by direct debit, within 14 days of the boat being returned in good clean condition. Any first aid items, lost items, damage, or additional cleaning charges will be deducted from the bond.  

4. A description of your group (including number of males and females, and the average age of the people in your group) should be discussed with the owners during booking.  

5. Single sex groups and groups, where some or all of the occupants on the boat are under the age of 30, may incur a higher security bond, to be determined by the proprietor. 

6. Any additional bond will be payable at the time of paying the hire fees.  

7. The hirer agrees, that should the security bond paid be insufficient to meet the costs of damaged caused, a further charge, substantiated by documentation, will need to be paid.  

 

GENERAL CONDITIONS  

1. The hirers are required to keep all houseboat travel within the designated area as advised by the proprietor. The designated area is along the Murray River, between Corowa and Mulwala, with the western boundary defined by Drain Lane.  

2. Houseboats hire - 7 night bookings departing either Monday PM.  

3. The boat is available from 3PM on the first day of hire and must be vacated by 10AM on the final day of hire.  

4. Early arrivals may get access sooner subject to readiness of boat.  

5. Special requests for bookings outside these times will be considered but may result in additional fees.  

6. Prior to the hirer taking possession and departing the moorings, the hirer and all members of the group are required to read and sign the conditions of hire, and provide their full name, address, email address, telephone and signature.  

7. No boat is permitted to leave the moorings, unless a member of staff has conducted a complete and thorough operational run through and instruction session covering both the ‘on boat’ and ‘on water’ rules.  

8. If arriving after 4pm please phone 0428 295 261 prior to arrival.  

9. All hirers must arrive at least two (2) hours prior to sunset to board the houseboat on the pre-arranged date.  

10. If any further guests arrive after dark, the boat will depart the wharf the following morning as arranged with the proprietor.  

11. The boat may only move during daylight hours within the designated area on the Murray River. 12. If the group, as described when the houseboat booking was made (ie. number of males and females and the average age of the people in your group), differs from the group on arrival, the proprietors reserve the right to nominate an additional security bond to be paid or terminate the hire without reimbursement of hire fees.  

13. Occupants under 18 years of age require the signature of a parent or guardian.  

14. Sub-letting of the boat is not permitted.  

15. The houseboat must be returned in good clean condition or an extra cleaning charge will apply (to be determined by the proprietor). All rubbish to be removed by the hirer. Recycling bins will be provided at the wharf.  

16. Any damage to the houseboat or its equipment must be reported to us immediately at the conclusion of hire, so an assessment can be made and remedial action taken.  

17. Smoking is NOT permitted inside the houseboat. Cleaning of fish inside the houseboat is also prohibited. Extra cleaning charges will apply.  

18. No pets, firearms, motorbikes or chainsaws are allowed onboard the boat.  

19. In the unlikely event of unfavorable river conditions, or any unforeseen circumstances, causing danger to the river craft prior to departure, the proprietors reserve the right to re-arrange the booking. If not suitable a refund of the hire fee and the bond will be made. A booking fee of $100 will be deducted. Every effort will be made to give notice in advance if such circumstances arise.  

20. We cannot be held responsible if activities and/or events cannot be undertaken on the Murray River due to unforeseen circumstances.  

21. We agree to have the boat, motor and accessories in good working order. We will not be obliged to compensate the hirer for loss of time due to unforeseen mechanical problems during the hire period but do undertake to repair mechanical damage as soon as possible.  

22. We cannot guarantee uninterrupted power supply for medical devices. If an occupant has a medical device, such as a sleep apnea machine, you are advised to bring your own back up power supply for the device. 2 

3. Anyone who drives the boat must be over 18 years of age and must hold a full current car drivers license or boat license, and must not drive the houseboat whilst under the influence of intoxicating liquor or drugs.  

24. The number of people on the boat must not exceed the number of berths allowed for under the NSW Maritime Services Board regulations. A child over the age of 12 months is counted as one (1) person. A breach of this condition will see the hire terminated immediately and instant loss of monies, without exception.  

25. For safety reasons, we do not recommend young children onboard who cannot swim, with or without life-jackets. All ages of guests to be discussed with the proprietor before booking.  

26. Secure undercover parking is offered on the property however no responsibility will be taken for damage or loss from external circumstances. One (1) set of vehicle keys are to be left with the proprietor during length of houseboat hire.  

27. Upon signing the hirer’s agreement, the hirer(s) agree that the owner has issued clear instructions on the correct and safe handling of the vessel, location and use of lifesaving appliances, location of fire appliances and any limits of operation of the vessel. 

 

CANCELLATIONS  

1. Cancellations prior to paying the hire fee will invoke a $200 cancellation fee.  

2. A refund of the balance of the bond paid will be made if the boat is able to be re-hired.  

3. If a cancellation is made after the hire fee has been paid a refund will only be made if the boat is rebooked for a similar period.  

4. Requests to transfer or reschedule bookings will be considered but not guaranteed. 

5. A cancellation fee of $200 applies to clauses 3 and 4 above.

The following are the terms of trade of Feliz Puente Pty Ltd ABN 79 625 999 877 (“BridgeClimb Sydney”).  These conditions apply to bookings made from 21 August 2020 onwards, including new bookings made with credit vouchers issued following trip cancellations.  

 

BridgeClimb Sydney is the seller of all climbs over the Sydney Harbour Bridge (“Climbs”), all gift certificates for Climbs (“Gift Certificates”) and other ancillary items, including but not limited to photographs, videos, merchandise, food and beverages. All dealings with BridgeClimb Sydney will be on these Terms of Trade (“Terms”) unless otherwise agreed in writing by BridgeClimb Sydney. These Terms are also subject to revision and change without notice.   

 

These Terms, along with the Climber Declaration and Disclaimer Form and all health and safety information provided to persons who take part in Climbs (“Climbers”) comprise the Agreement between BridgeClimb Sydney and the Climber or any other person acquiring a product or service from BridgeClimb Sydney. 

 

1. CLIMB 

BridgeClimb Sydney reserves the right to add, withdraw, substitute and/or vary advertised routes and departure times (“Arrangements”) for Climbs without notice for reasons of safety, health, security or as a result of or due to restricted access as required by any commonwealth, state, territorial or local government agency or body (including, any transport, road or maritime authority in New South Wales) (“Government Agency”), or any matters out of the reasonable control of BridgeClimb Sydney. However, reasonable endeavours will be made to maintain Arrangements as advertised. 

 

2. CHECK-IN FOR A CLIMB 

All Climbers climbing on the Sydney Harbour Bridge (“Bridge”) are required to arrive and ‘check-in’ at BridgeClimb Sydney’s premises at least 15 minutes prior to the advised departure time as per Climber’s voucher or confirmation advice (“Proof of Purchase”). Subject to clause 9.1, failure to arrive by this time may result in non-admittance to a Climb at BridgeClimb Sydney’s discretion, without refund. 

 

3. REQUIREMENTS TO PARTICIPATE 

3.1 Climbers must hold a valid Proof of Purchase. Entry may be refused if the Proof of Purchase is damaged or defaced in any way or not purchased from an authorised point of sale. Should a dispute arise over the validity of a Proof of Purchase, BridgeClimb Sydney reserves the right to refuse participation in a Climb unless Climber is able to show proof of their identity. 

3.2 Climbers must be 8 years of age or over, be at least 120cm, be of sound mind and be in good health. Climbers may be required to undergo a test to assess whether they are capable of completing a Climb. Every three Climbers between the ages of 8 and 15 inclusive climbing together must be accompanied by one paying adult Climber. 

3.3 Prior to entering the BridgeClimb premises all persons including Climbers may be required to undergo a health assessment including, but not limited to, a temperature check.  Any person displaying flu like symptoms, including a fever, cough or runny nose, may be refused entry by BridgeClimb Sydney (in its discretion).  

3.4 Before purchasing a Climb, all Climbers must carefully read the Climber Declaration and Disclaimer Form (the ‘Form”) and before participating indicate their agreement to the matters set out in the Form by signing where indicated. If the Climber does not agree with any of the matters set out in this Agreement (including in the Form), that Climber must not purchase a Climb. If the Climber is under the age of 18 years and does not have the understanding necessary to sign the Form, the Climber’s legal parent or guardian must sign the Form on behalf of the Climber. 

3.5 BridgeClimb Sydney will perform a breath test on Climbers and may observe Climbers to ensure they are not under the influence of drugs (legal or illegal). Climbers will be refused participation in a Climb, without refund, if their blood alcohol concentration is 0.05% or greater, if they refuse to be breath tested or if BridgeClimb Sydney considers that they may be under the influence of drugs. 

3.6 Smoking is not permitted on BridgeClimb Sydney’s premises or on the Bridge. 

 

4. BRIDGECLIMB SYDNEY’S ABILITY TO REFUSE PARTICIPATION 

4.1 BridgeClimb Sydney may refuse participation in a Climb, if in BridgeClimb Sydney’s reasonable opinion the Climb or the participation of the Climber in the Climb may adversely affect the health, safety or security of BridgeClimb Sydney employees, agents, contractors and subcontractors (BridgeClimb Sydney Personnel), the Climber, other Climbers or the Bridge itself. At BridgeClimb Sydney’s discretion, the Climber will be either be rescheduled, issued with a credit voucher or reimbursed for the price of the Climb less administration and change fees, if a person is refused participation in a Climb for any reason other than by reason of breach of clause 2 above and 5.4 below. 

 

5. DURING A CLIMB 

5.1 BridgeClimb Sydney will supply Climbers with equipment for use during a Climb. Use of this equipment is mandatory. 

5.2 Climbers may take their own standard glasses (sun or prescription) on a Climb, at their own risk, provided that these glasses are securely attached using a BridgeClimb Sydney glasses lanyard and do not have any photographic or electronic devices included in their structure. At BridgeClimb Sydney’s discretion, potentially essential medication (e.g. asthma inhalers or other medication) may be taken on a Climb. While this will be done in secure manner by BridgeClimb Sydney Personnel, neither BridgeClimb Sydney nor BridgeClimb Sydney Personnel shall be responsible for the medication or the administering thereof. The Climber must not take part in the Climb if he or she has reason to believe that they will or are likely to require medication or the administration of medicines or medical assistance at any point during the Climb. 

5.3 Other than as set out in clause 5.1 and 5.2 above, Climbers are not permitted to take any items onto the Bridge (including but not limited to items such as cameras, videos, audio, pagers, mobile phones, handbags, satchels, wallets, watches, fitness trackers and any other personal items or effects) and must remove these items prior to undertaking the Climb. Climbers will be provided with a locker for storage of personal belongings. To ensure that unauthorised items are not carried on to the Bridge, Climbers may be required to pass through a metal objects screening system prior to undertaking the Climb, and BridgeClimb Sydney (in its discretion) may refuse a Climber’s participation in a Climb if a Climber is unwilling to remove any unauthorised items set out in this clause. 

5.4 All Climbers must obey the directions and instructions of BridgeClimb Sydney Personnel, and must not act disruptively or disturb other Climbers or interfere with a BridgeClimb Sydney Personnel’s ability to conduct any part of the Climb process in a safe and secure manner (including abiding by any social distancing requirements imposed by BridgeClimb Sydney) and must not damage, deface or remove any part of the Bridge or any of the equipment supplied for use on a Climb. Disruptive behaviour includes making any jokes or flippant remarks about security. BridgeClimb Sydney retains the right to remove from a Climb any Climber who does not comply with these terms, without refund. 

 

6. PHOTOGRAPHS AND OTHER IMAGE OR SOUND CAPTURE DEVICES 

6.1 Photographs obtained from BridgeClimb Sydney remain copyright to BridgeClimb Sydney and may only be used or reproduced by the purchaser or recipient for private or domestic purposes and must not be used for any commercial purpose, including promotion of any supplier or any supplier’s products or services, without BridgeClimb Sydney’s prior written permission. 

6.2 Climbers agree that BridgeClimb Sydney and its authorised sub-contractors have the authority to use and reproduce any photograph taken of Climber for any disclosed purpose including display and purchase by or on behalf of Climbers, without prior notice or payment of compensation to Climber. 

6.3 Cameras and other image or sound capture devices are not permitted on the Bridge unless supplied by BridgeClimb Sydney. 

6.4 Climber agrees that BridgeClimb Sydney may inspect bags, containers or any other items brought onto BridgeClimb Sydney’s premises. Climber also agrees that if an unauthorised image or sound capture device is taken onto the Bridge then BridgeClimb Sydney may remove or delete any images, sound or any other material from the device that pertains to the Bridge or BridgeClimb Sydney. 

 

7. TERMS OF PAYMENT 

7.1 Subject to clause 9.1, the purchase of a Climb is non-transferable and specific to a particular Climb as stated in the Proof of Purchase. Climbs and Gift Certificates, rights or entitlements to Climbs and Gift Certificates, or to purchase Climbs and Gift Certificates must not be offered as prizes, offered for sale or resale, or resold or used for any commercial purpose (including without limitation promotion of any supplier or any supplier’s products or services) without BridgeClimb Sydney’s prior written consent. If BridgeClimb Sydney reasonably believes that these activities have occurred without such consent, the holder of a reservation or Gift Certificate may be refused participation in a Climb, without payment of 
any compensation. 

7.2 Climb times reserved can be changed by the Climber with no fees up to fourteen days before the original Climb date, and changed only by time or date to another available time or date. Changes requested within 14 days to 72 hours incur a $30 change fee per booking, and changes within 72 hours incur a $100 change fee per booking.  If the Climber purchases the ‘Flexi option’ then Climb times may be changed by the Climber up to 24 hours before the original Climb date and time, and changed only by time or date to another available time or date.  Reduction in the number of participants or changes to the identity of Climbers is not permitted. BridgeClimb Sydney reserves the right to charge a rebooking fee and an administrative fee for other requested changes where permitted by BridgeClimb Sydney. The applicable rebooking fee and administrative fee can be obtained by contacting BridgeClimb Sydney on 1300 908 057.   

7.3 All Climbs must be paid for at the time of making the reservation unless otherwise agreed by BridgeClimb Sydney in advance. 

7.4 Depending on the payment method used when booking, a transaction fee of 1% may apply. The surcharge applies to all bookings using the following payment methods; AMEX, VISA, MasterCard, PayPal, GooglePay, Alipay and ApplePay. 

 

8. CANCELLATION AND REFUNDS 

8.1 Climbs will not proceed if BridgeClimb Sydney decides in its absolute discretion, whether for health, safety or security reasons or other reasonable reasons, including but not limited to restrictions on occupancy and/or  movement imposed by a Government Agency (including social distancing requirements), to cancel a Climb. 

8.2 Should a Climb not proceed then Climbers will be re-scheduled at their convenience, be issued with a credit voucher, or be reimbursed the price paid for a Climb less associated administration and cancellation fees, but otherwise shall have no claim whatsoever (including no claim for travel expenses or any other out of pocket expenses) relating to the cancellation of a Climb.  

Cancellations up to 14 days before the climb date will incur a $25 per adult ticket, cancellations within 13 days to 72 hours will incur a 25% cancellation fee per booking and within 72hrs a 50% cancellation fee per booking will be charged. In the case of purchases bought through a Reseller, that Reseller will be responsible for redeeming the refund voucher and making reimbursements to a Climber. 

8.3 Subject to clause 12.1, Gift Certificates are not refundable. 

 

9. BRIDGECLIMB SYDNEY'S LIABILITY 

9.1 Nothing in these Terms excludes, limits or modifies any condition, guarantee, warranty, right or remedy implied or imposed by any statute or regulation which cannot lawfully be excluded, limited or modified. This may include the Australian Consumer Law which contains guarantees that protect the purchasers of goods and services in certain circumstances. Subject to the last sentence, express or implied guarantees, representations, conditions, warranties and other provisions relating to these Terms, or provision of products and services as contemplated by these Terms, are excluded from these Terms to the maximum extent permitted by law. 

9.2 If any guarantee, warranty, term or condition is implied or imposed in relation to these Terms under the Australian Consumer Law or any other applicable legislation and cannot be excluded 
(a “Non-Excludable Provision”), and BridgeClimb is able to limit remedy for a breach of that Non-Excludable Provision, then the liability of BridgeClimb for breach of that Non-Excludable Provision is limited to one or more of the following at BridgeClimb’s election: in the case of products, to: replacement of the products or supply of equivalent products, repair of the products; payment of the cost of replacing the products or of acquiring equivalent products; or payment of the cost of having the goods repaired; and in the case of services, to: supply of the services again; or payment of the cost of having the services supplied again. This clause 9.2 is subject to clause 9.4. 

9.3 The Climber acknowledges that the Climb is a recreational activity that involves an element of risk and BridgeClimb Sydney, any transport, road or maritime Government Agency or authority in New South Wales and any reseller of BridgeClimb products (Service Providers), therefore cannot guarantee the Climber’s health and safety. These risks include the risk of physical injury or death, the inducement or exacerbation of medical conditions, mental harm or distress, and damage to their property. The Climber acknowledges that his/her health, ability and conduct will affect such risks. 

9.4 Section 139A of the Competition and Consumer Act 2010 (Cth) in certain circumstances permits a term of a contract for the supply to a consumer of recreational services to exclude liability of the supplier pursuant to sections 60 to 63 of the Australian Consumer Law for death or personal injury in relation to that supply. To the extent permitted by section 139A, BridgeClimb excludes all liability for death or personal injury in relation to supply of recreational services. 

9.5 Subject to sections 9.1, 9.2 and 9.6: 
(a) to the extent the Climb is a “recreational activity”, “recreational service” or the like under any applicable law, the Service Providers (and their respective directors, employees, agents, sub-contractors, associates and assignees) (the “Relevant Persons”) exclude all: 
(i) liability under any applicable statutory guarantees (including but not limited to guarantees 
under the Australian Consumer Law); 
(ii) express or implied warranties and conditions, including without limitation that the Climb will 
be provided with reasonable care and skill. 
(b) The Climber, and (where Climber is under the age of 18 years and does not have the understanding necessary to sign the Form) the legal parent or guardian signing this Agreement on behalf of the Climber, absolutely, unconditionally and irrevocably releases and indemnifies the Relevant Persons from and against all action, proceedings, claims, demands, costs, losses, damages and expenses suffered or incurred by the Relevant Persons arising out of or in connection with any participation in the Climb. 
(c) the Relevant Persons will not be liable for any costs, losses, damages and expenses that may be suffered or incurred in connection with the Climber’s participation in the Climb or their presence on the Bridge; and 
(d) this Agreement may be pleaded by any of the Relevant Persons in bar to any actions, proceedings, claims, demands arising out of or in connection with the Climber’s participation in the Climb or presence on the Bridge. 

9.6 Nothing in this section 9 above limits or excludes the liability of the Relevant Persons for any costs, losses, damages or expenses to the extent arising as a result of fraudulent or reckless conduct of the Relevant Persons, nor any liability of the Relevant Persons that cannot be excluded under applicable law. 

10. RESELLERS 

Where a Reseller enters into a sale, reservation or any other transaction, the Reseller shall indemnify BridgeClimb Sydney for any loss, damage or expense incurred by BridgeClimb Sydney as a result of any misrepresentation, breach of contract by or negligence of the Reseller. 

 

11. CHANGES TO TERMS AND CONDITIONS 

All Terms and Conditions stated are subject to change without notice. 

12. GOVERNING LAW 

This Agreement is governed by the laws of New South Wales, Australia. BridgeClimb Sydney and each purchaser and Climber submit to the non-exclusive jurisdiction of the Courts of New South Wales and the Commonwealth of Australia in respect of this Agreement and any dispute between them.

Important Information for Bridgeclimb 

  1. If you are pregnant, 75 years of age, or older, or have any pre-existing health conditions please refer to the Health & Safety Essentials section via the Pre-Climb Checklist link above as you may need to provide a BridgeClimb Certificate of Fitness note before you climb (Please note the Certificate of Fitness must have been completed within the last three months prior to your Climb date). 
  1. Children from the age of 8 to 15 (inclusive) are welcome to join their parents or guardian on the Climb of their life, provided they are 1.2 metres in height or taller. Children are the responsibility of an adult, with a maximum of three children per adult. 
  1. No Cameras, Phones, Video devices or GoPros are allowed on the Bridge. Our Climb leaders will capture your journey. 
  1. We breath test all Climbers for alcohol and you need to be under 0.05 to be allowed to Climb. If Climber blows over, a reschedule fee will be charged or Climber may forfeit their Climb. 
  1. This is an all-weather activity and operates in all conditions except for electrical storms and extreme wind. 

 

For Dreamtime Southern X 

  • All bookings subject to availability.

  • Payment – on approval of credit application, payment due 7 days on receipt of invoice. 
  • Pre-payment is required for group bookings. 
  • A minimum of 15 paying passengers is required to access a private-exclusive group tour and group rate for The Rocks Aboriginal Dreaming Tour. 
  • The child/ren rate is applicable to 3-16 years of age (proof of age may be requested on the day). Children under 3 years of age are FOC. Children aged 3-5 are learners and are $13.00 with 25% commission. Students aged 16+ are classified as Adults. 
  • Guests must arrive at Cadman’s Cottage courtyard area opposite overseas cruise passengers terminal (110 George Street, The Rocks) 15 minutes prior to set departure time. No refund will be provided for late arrivals. 
  • The tour is an all-nature activity, ‘rain – very windy or very hot sun is cultural for Aboriginal people’. No cancellations will be accepted due to weather. 
  • As this is an outdoor tour, we recommend guests wear comfortable walking shoes, sunscreen and a hat, and bring a bottle of water. Wet weather gear will be necessary on rainy days. 
  • All participants undertake The Rocks Aboriginal Dreaming Tour entirely at their own risk. Dreamtime Southern X accepts no responsibility for any loss or damage (including, but not limited to, any personal injury, loss and/or damage to property), howsoever arising out of, or in any way connected to The Rocks Aboriginal Dreaming Tour. 
  • We encourage our customers to purchase travel insurance. 

 

Cancellation Policy 

  • All prices quoted in AUD and are GST inclusive. 
  • All bookings subject to availability. 
  • Booking is confirmed upon receipt of payment. 
  • No refund will be provided for late arrivals. 
  • Individual cancellations must be received 24 hours prior to the tour commencement otherwise full payment will be incurred. 
  • If the exclusive group is cancelled within 30 days and prior to 14 days from the tour date, no cancellation fee shall apply. If the exclusive group is cancelled within 14 days and prior to 7 days from the tour date, 50% of the tour cost shall be payable as a cancellation fee. 
  • If the exclusive group is cancelled within 7 working days of the tour date, 100% of the tour cost shall be payable as a cancellation fee. 
  • Tours and other experiences offered by Dreamtime Southern X are all-nature activities, "Sun-heat" or ‘Rain is cultural for Aboriginal people’. No cancellations will be accepted due to weather. 
  • We recommend guests wear comfortable walking shoes for tours. Warm or wet weather gear will be necessary on cold or rainy days/evenings. 

 

Royal Botanic Gardens Sydney Trust Engagement and Education Centre 

The Royal Botanic Gardens and Domain Trust (RBGDT) reserves the right to cancel any event in case of extreme weather or if minimum participation numbers are not met.

a. Wet Weather 
All booked programs will go ahead in wet weather, unless it is an extreme weather condition. See the Extreme Weather Guidelines for more information. 
 
b. Online tickets 
No refunds apply for cancellation of tickets purchased online. 
A request for a date change can be made in writing no less than 48 hours prior to the program commencement time. Approval of a date change is at the discretion of the RBGDT. 
  
c. Extreme Weather 
Despite other clauses, if an extreme weather condition under the Extreme Weather Guidelines occurs, 

  1. RBGDT may in accordance with the Guidelines: 
  1. cancel or modify the event without incurring any liability to the participating group, subject to paragraph (v); 
  1. hold the event at a different date if an agreement has been reached between RBGDT and the participating group, by providing a notice of Extreme Weather to the participating group, as soon as practicable. 
  1. The participating group shall notify RBGDT, as soon as practicable, if it considers that the event needs to be cancelled or modified due to any health conditions of any participants affected by or in relation to any extreme weather condition. 
    For avoidance of doubt, the participating group may not cancel or modify the event without RBGDT’s approval.   
  1. the notice issued under paragraph (i) and (ii) needs to include: 
  1. the nature of the extreme weather condition; 
  1. to the extent assessable, the expected duration of the extreme weather condition; 
  1. the event affected by the extreme weather condition and the extent to which the event needs to be modified or cancelled. 
  1. the participating group is responsible for its participants’ health, wellbeing and safety. The participating group will identify any of its participants who have a health condition that would be adversely affected by any weather condition, and withdraw some or all of its participants from the event, subject to RBGDT’s approval. 
  1. If an event is cancelled due to an extreme weather condition, RBGDT will refund any payments made by the participating group to RBGDT, deducting any administration fee or any other non-refundable costs incurred in relation to the event.

Accordingly, any pre-payment you have made in relation to the booking will be forfeited to The Anchorage Hotel/Spa under this term. 
  • Bookings are subject to the availability.  
  • If you wish to check-out later than the 11:00am check-out time you must obtain approval from The Anchorage Hotel/Spa at least 12 hours prior to your scheduled check-out time. Late check out approval is subject to availability 
  • Due to the structure of our accommodation houses, views vary. All requests will be taken into consideration but NOT guaranteed. 
  • Your booking will include daily room servicing unless the rate booked specifically states otherwise. Additional room services can be arranged directly with The Anchorage Hotel/Spa Property and charges will apply. 
  • Strict noise restrictions apply after 10:00pm, any complaints will result in additional charges and possible eviction. In the event that any guest is identified as having a party, the hotel reserves the right to immediately request all occupants of the room up to, and including, the guest who has registered for the room to vacate the premises. In the event that an eviction does occur, the accommodation is non refundable. In addition the registered guests will be required to settle the account prior to departure for any expense resulting from additional cleaning of the room, replacement of any furniture/fixture/fitting breakage, as well as for any required repairs. 
  • The Anchorage Hotel/Spa is a non-smoking property, any evidence of smoking of any kind will incur a $300 additional cleaning fee and may result in eviction from the property. 
  • “Child” or “Children” means a person or persons aged between 3 years and 14 years; “Infant” means a person under the age of 3 years; and “Adult” means a person aged over 14 years. All ages will be determined from the date at which accommodation commenced. 
  • Children aged 2 and under are complimentary when no additional bedding is required. A port-a-cot can be provided for an additional charge. Children aged between 3 and 14 years will be charged the additional child rates for each child staying in a room. Persons aged over 14 years will be charged an additional Extra Person rates for each person staying in a room. 
  • All guests under the age of 18 must be accompanied by a responsible adult such as a parent, step-parent, guardian or other adult who has parental rights and responsibilities for the under 18 year old guest.  If a guest is found to be a person under the age of 18 who is not accompanied by a responsible adult The Anchorage Hotel/Spa may immediately cancel the guest’s booking and the full booking amount will be forfeited to The Anchorage Hotel/Spa under this clause.

Imagine Cruises 

General Policy for all cruises: 

  • Subject to availability at time of booking.  
  • Redemption period: 18 August 2023 – 27 March 2024.  
  • Imagine Cruise offers a Whale Watching cruise from May to early November or a Dolphin Cruise from November to April. Cruise type depends on the season.  
  • All cruises are quoted in Australian Dollars and inclusive of Goods & Services Tax (GST). 
  • All cruises are non-smoking this includes e-cigarettes. 
  • At the discretion of the Vessel’s Master and Owner cruises may be terminated or passengers removed from vessel due to antisocial or disorderly behaviour. If water police are required to be called, this will be at the passenger’s own expense. 
  • High heeled shoes, including wedges, are not permitted onboard. 
  • Prams and strollers are permitted onboard. 
  • All cruises (unless otherwise stated) will depart from Dock C D’Albora Marina, Teramby Road Nelson Bay. 
  • Boarding commences 20 minutes prior to departure time, failure to board the vessel at this time will result in cancellation of your booking without refund. 
  • Imagine Cruises is not suitable for guests in wheelchairs/motorised wheelchairs, or guests with limited mobility. Guests are required to manage 6 stairs to board the vessel. 
  • Imagine Cruises are bound by the NSW liquor act and must abide by the guidelines for the responsible service of alcohol during all cruise operations. BYO alcohol is not permitted onboard the boat. 
  • Imagine Cruises have the right to request disembarkation or deny a passenger boarding the vessel due to a guest showing signs of intoxication of drugs or alcohol for the safety of staff and other passengers. 
  • This Company reserves the right to cancel due to insufficient bookings. Every effort will be made to ensure the cruise goes ahead however at times there may be short notice of cancellation. 
  • Imagine Cruises reserves the right to cancel, abandon or vary any cruise due to adverse weather conditions. The company will not be held liable for any loss or expense incurred by passengers. 
  • The passenger acknowledges that during the cruise the vessel will be and will remain under the absolute control of the company, and that the direction and control of the vessel and its crew is at all times the sole responsibility of the Master of the vessel. 
  • Imagine Cruises does not accept any liability in contract or in tort for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force majeure or other events which are beyond our control, or are not preventable by reasonable diligence on our part including but not limited to; war, civil disturbance, fire, flood, unusually severe weather, acts of God, acts of Government or of any authorities, or failure of machinery (including vessel engines) or equipment or industrial action. 
  • Fares and itinerary are always subject to variation without notice. 
  • Sails will be hoisted at the discretion of the Master and is ultimately weather dependent. 
  • NO passenger is entitled to any particular seat; all seating is at the discretion of the Master. 

 

SCHEDULED CRUISES 

Booking Policy: 

  • All cruises must be paid in full online or via phone before boarding. 
  • Child is aged 4 – 14 years, all children must be accompanied by an adult when onboard the vessel. 
  • Family tickets are valid for 2 Adults and 2 Children between the ages of 4-14 years old. 
  • Concession rates are available for full time students, seniors or pensioners; upon boarding concession cards must be sighted. Failure to show a concession card might mean the guest is liable for the cruise fare difference. 
  • Guests holding a Companion card travel at half the ticketed price. Bookings can be made over the phone or in the office. Upon boarding companion cards must be sighted. Failure to show card may result in full fares applying.. 

 

Cancellation Policy: 

  • Imagine Cruises have the right to cancel a cruise for any reason, including bad weather or insufficient numbers. Should Imagine Cruises cancel a cruise, passengers will be offered to reschedule, to put booking on hold until you have a new date or a full refund. 
  • Should you wish to cancel or reschedule your booking outside of 24 hours of your travel date you must provide this in writing to (Sydney, Melbourne, Brisbane, Adelaide, Canberra, Perth, Darwin) info@imaginecruises.com.au where our staff can provide a full refund or reschedule your cruise. 
  • Should you wish to cancel or reschedule your booking inside of 24 hours of your travel date you must provide this in writing to info@imaginecruises.com.au. At this time, you will ONLY be allowed to reschedule your cruise, NO Refunds are given. 
  • A $10 administration fee may be applied for changes and/or cancellations, this is at Imagine Cruises management discretion. 
  • Please email: info@imaginecruises.com.au with your booking number which will read IM00xxxx for public cruises to advise us in case of changes. 

 

Risk Warning 

  • Passengers travel at their own risk. Whilst all care is taken to ensure the safety of our passengers, Big Cat South Pacific Holidays Pty. Ltd. accepts no responsibility for any injury, damage or loss of property caused whilst aboard the vessel or during any cruise. 
  • Once on board a Big Cat South Pacific Holidays Pty Ltd vessel all persons are under the authority of the vessel’s Captain and Company Management, and are expected to conduct themselves in a socially acceptable manner. The law is clear about the “Responsible Service of Alcohol” and licensed venues are entitled to refuse service to people who are intoxicated or disorderly. Imagine Cruises reserves the right to return to dock and disembark any disorderly passengers without refund. If Police attendance is required all costs will be incurred by the passenger(s) concerned. 
  • Passengers must not bring any alcoholic beverages or illegal substances onto the vessel. ID may be required to purchase alcoholic beverages. 
  • These terms are an integral part of the contract between passengers and Big Cat South Pacific Holidays Pty Ltd. When your booking/ticket is confirmed, it will be deemed at all times that you have read, understood and accepted the conditions hereof, and agreed to the terms herein contained.

You should understand that when participating in any paid Sandboarding Activity there is the possibility of physical injury. If you engage in this Activity you agree that you do so at your own risk and by participating in these activities, you take all risk of injury to yourself, and agree to release and discharge 4WD Tours R Us Pty Ltd from any and all claims or causes of action, known or unknown, arising out activity’s undertaken while participation in the paid sandboarding activity or the transfer between locations with 4WD Tours R Us Pty Ltd 
You should be in good physical condition and be able to participate in the Activity.

In these Terms and Conditions: 

  • “Booking” means a reservation of the Property for a particular period. 
  • “Property” means Basalt Luxury Accommodation and all its fixtures, fittings, and equipment and the land upon which the accommodation is situated. 
  • “Us/We/Our” means the managers and/or owners of the Property. 
  • “You/Your/Guests” means the person/s who are permitted to stay in the Property pursuant to the Booking. 

 

All Bookings made are subject to these terms and conditions and You are deemed to have accepted these terms and conditions. 

Bookings & Cancellations Policy 

  1. If you book less than 14 days in advance the entire booking amount will be payable at the time of booking. 
  1. A $250.00 credit card authorisation will be held prior to Your check-out and released 3 days after check-out less any damages and applicable additional charges. 
  1. Bookings may be transferred to another Guest only with Our prior written approval. Please refer to Bookings and Cancellations Policy. 
  1. All Bookings are subject to availability at time of Booking. 

If You wish to vary or cancel Your Booking, please contact Us immediately either through the Booking platform you used or by emailing Us on stay@basaltorange.com.au 

  1. If You need to cancel your Booking the following conditions apply: 
  • more than 30 days notice = full refund or credit provided. 
    • less than 14 days days notice = No refund or credit provided. 
    • If You cancel Your Booking between these two timeframes, You will not be charged the balance of your booking (60%).
    • If We are able to rebook your studio for Your dates You will receive a full refund. 
  1. If You need to vary Your Booking the following conditions apply: 
  • more than 14 days notice = variations permitted subject to min. night policy and availability. 
  • less than 14 days days notice = variations not permitted. 
  1. If We are forced to close due to government travel bans (including pandemics, natural disasters etc) which impact your Booking with Us, You will be issued a full credit to use at a future date. 

 

House Rules 

Guests agree to comply with the rules outlined below and any fair and reasonable request made by Us during your stay. 

  1. Parties, gatherings or functions are not permitted on the Property. 
  1. Smoking is not permitted inside the studio, nor on the front deck, nor within 10m of any studio. 
  1. No pets are allowed onto the Property apart from trained assistance dogs. Please advise Us at time of Booking if You do plan to bring an assistance dog. 
  1. Excessive noise is not permitted and is unwanted in such a peaceful place. Please be mindful of other guests and Our neighbours when playing music or using the outdoor fire pit. 
  1. The Property is strictly for Guests only. Only Guests nominated on the check-in form are to stay in a studio. Visitors are not permitted onto the Property at any time (apart from approved tour & experience operators). 
  1. The maximum number of Guests staying in a studio is two. 
  1. The Property is unsuitable for children or teenagers. Guests must be at least 18 years of age to stay at the Property. 
  1. Outdoor firepits are not to be used on days declared a total fire ban, nor on days where fire risk is excessive. You will receive advice from Us on days where fire pits are not to be used – please adhere to Our directions in this regard. 
  1. Whilst You are welcome to use the well-worn orchard tracks to walk through the cherry orchard (please refer to the map and safety directions provided), please ensure that You do not enter the cherry tree rows or climb on or amongst the trees nor on any farm equipment. 
  1. Cars are to be parked in the nominated carpark area at Your studio and not on the grass. 
  1. You are welcome to move the dining table and chairs onto the deck area but please move these items back inside when not in use. Please do not use these items outside in wet weather. Please do not remove any other furniture from the studio. 
  1. No hunting is permitted on the Property at any time. 
  1. Do not approach any wildlife on the property under any circumstances. 

 

A breach of any of the above conditions may result in immediate eviction from the Property. 

Any damage, loss or expense incurred by Us as a result of any breach of these House Rules by You will covered by the $250 authorisation charge. Additional costs will be charged against Your credit card provided during the Booking process. This may include, but not be limited to, any breakage, damage or excess cleaning requirements. 

 

Privacy Policy 

You consent and authorise Us to collect, use and disclose Your personal information for the purposes of administering Your Booking, providing You with any services associated with Your Booking and for the purpose of informing You about offers and promotions which relate to the Property. 

 

Please note that We do not supply anyone with Your credit card information – this is stored securely in an encrypted vault by Our merchant facilities. 

 

If You have any questions about how we collect, store and use Your personal information, please contact Us in order to access or correct Your personal information. 

 

Limitation of Liability 

  • We strongly encourage and recommend the use of travel insurance as Our terms and conditions are strictly enforced. 
  • We accept no liability or responsibility for activities and experiences sold on behalf of third party suppliers. 
  • To the extent permitted by law, You acknowledge and agree that all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on 
  • Us are excluded under these terms and conditions and that We shall not be liable for any claim or cause of action You may have (including for negligence) arising from any injury, loss or damage arising either directly or indirectly out of Your stay at the Property. 
  • Nothing contained in these terms and conditions excludes, restricts, or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law, provided that, to the extent that such law permits Us to limit Our liability, then Our liability is limited to: 
  • in the case of services, supplying the services again or payment of the cost of having the services supplied again; and 
  • in the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired. 

 

Rowlee Wines 

  • Based on availability at time of booking.  
  • Booking redemption period: 18 August 2023 to 27 March 2024. 
  • Tasting experiences at Rowlee are not redeemable on wine purchases.  
  • To ensure the integrity of the tasting experiences, we kindly 
    request that all children are under constant supervision and remain seated at all times inside the Cellar Door. 
  • Please include all members of your party in your booking including those who aren’t tasting; so we can accommodate them. 
  • Sessions are strictly limited to 60 minutes so please arrive on time to get the most from  
  • your tasting experience. Your experience will be held for 15 minutes, beyond that you will need to call to inform us you will be late. 
  • For cancellations within 48 hours of your experience we are unable to provide a refund.  
  • We thank you for your cooperation and look forward to welcoming you to Rowlee.  

 

Printhie Wines 

  • Based on availability at time of booking.  
  • Booking redemption period: 18 August 2023 to 27 March 2024. 
  • Experience starts at 12nn.  
  • Please advise dietary requirements at time of booking.    
  • Please ensure you provide the name, phone and email contact for each participant. It must be the participants own phone and email. This also applies for tour operators. 
  • We require minimum 24hrs notice of booking cancellation to receive a refund. Refunds will not be provided due to traffic delays leaving Sydney or inclement weather. System booking fees are not refundable. 
  • Wine tasting is only available to Adults 18+.  
  • Due to current capacity limits within our cellar door, all children and non-tasters need to be included in your group head count (which cannot exceed 8). 
  • If you arrive 15 or more minutes late, your tasting may be forfeited. 
  • Please note there is a dam on the site and children need to be supervised at all times.

TERMS AND CONDITIONS 

  • By undertaking this activity you are agreeing that you are physically fit and of good health and able to cope with such demands of a guided sea or river kayak tour. 

IMPORTANT INFORMATION 

  • You will be on the water for a considerable amount of time. 
  • Children under 5 years old may be too young to cope with such tours. 
  • The minimum age for ALL our tours is 5 years old – with the exception of our Brunswick River Nature tour, where we can take children as young as 3 years old. 
  • Children (ages 5-15 years) must be accompanied by an Adult (16 years or older). 
  • Women more than 15 weeks pregnant should consider the safety risks prior to booking such tours, we advise against kayaking after this stage of pregnancy. 
  • Sea sickness can & will occur if you suffer from sea/motion sickness. We suggest if you are prone to sea/motion sickness please take measures such as patches or medication PRIOR to your tour. No refunds can be given if you become sea sick on the tour. 
  • Please restrict your alcohol intake on the evening prior to your tour. Excessive alcohol consumption can cause sea sickness. 
  • You will be kayaking on the ocean, heavy clothing is not suggested to be worn. 
  • Tours will only proceed if minimum numbers are met – we will contact you by sms & email to provide you with your options (reschedule/refund) if minimum numbers aren’t met. 
  • A full safety briefing and kayaking “basics” lesson is provided prior to your tour by our guides. 

AMENDMENTS & CANCELLATIONS 

  • Amendments to bookings can be made provided you give us at least 24 hours notice. 
  • 100% refund given if you cancel your booking more than 24 hours prior to your booked tour’s commencement. 
  • No refunds given for amendment or cancellation requests you make within 24 hours of your tour’s commencement, and no refunds given for “No Shows”, but rescheduling can be arranged for a $25 per person fee. 
  • You must send ALL amendment and cancellation requests in writing to us at info@goseakayak.com.au at least 24 hours prior to your booked tour’s commencement. 

WEATHER 

  • Our tours will proceed if it’s raining. 
  • Unsafe wind and swell are what may force a cancellation or postponement of your tour. In this case we will contact you via sms & email to reschedule or refund you according to your preference. 
  • Please keep your mobile phone switched on on the morning of your tour in case we need to contact you. 

CANCELLATIONS FOR UNSAFE WEATHER CONDITIONS 

  • For bookings made directly with us either through our website or in person, a 100% refund will be given if we have to cancel your tour due to unsafe weather conditions. 
  • Please note that if you have booked through a third party website, booking or travel agent then your booking may be subject to administration or other fees. 
  • We will contact you via sms and email if the weather forces us to cancel/postpone your tour. Please keep your mobile phone switched on on the morning of your tour in case we need to contact you. 

DAYLIGHT SAVINGS 

  • Daylight Savings Time runs in New South Wales (NSW) from October to April each year. During this time Byron Bay is one (1) hour ahead of Queensland (QLD). If you are coming from QLD during this time please make the necessary adjustments to your schedule. 
  • For example 9:30am in Byron Bay during daylight savings is 8:30am in Surfers Paradise, Brisbane and the Gold Coast between October and April each year. 
  • No refunds can be given for tours missed due to time differences. 

DRIVING & PARKING in BYRON BAY 

  • If using your own transport to get to the tour please aim at arriving 20 minutes before the scheduled tour starts. 
  • There is paid parking on the roadside at our location, opposite 56 Lawson Street Byron Bay, between 9am and 6pm daily. 
  • There is 4 hour free parking nearby on Massinger Street – as shown on our FAQs page: Pick-ups map available here 
  • Please be aware that Byron Bay is a little town with BIG traffic problems, if you are within 1.5km of us you will walk a lot quicker to us then the time it takes for us to pick you up and drive to our location. 

BYRON BAY PICK-UPS 

  • We offer free pickups for our guests from 6 locations around Byron Bay – as shown on our FAQs page: Pick-ups map available here 
  • Please be aware that Byron Bay is a little town with BIG traffic problems. During peak seasons, if you are within 1.5km of us you will walk a lot quicker to us then the time it takes for us to pick you up and drive to our location. If you decide to walk to us instead of being picked up, please let us know ASAP so we can tell the driver. 

WHAT TO BRING 

  • Please bring: bathers, towel, sunscreen, small reusable water bottle, hat and clothes to change in to afterwards. 
  • If you suffer from sea-sickness or motion sickness, please take measures such as patches or medication prior to arriving for your tour. 
  • We have a lock up area for all bags/belongings. 

EQUIPMENT 

  • All safety and kayaking gear is provided. 
  • In cooler months we supply wetsuits to keep you warm. 
  • We have a secure lock up area for your belongings whilst you are out on tour.

  • We guarantee that if you don’t see a Dolphin, Turtle or Whale on your first tour with us in Byron Bay that you can join us again for free.

  • Your free return trip is NOT transferable to another person nor refundable.

  • The Cape Byron Marine Park is a culturally significant area to our local indigenous people, the “Arakwal” people, we ask that you respect this area by not contributing to littering, damaging/disturbing local flora and fauna. We ask that you join us in sustainable methods of interacting with Mother Nature and not interfere with the habitat of this spectacular area.

Lets Go Surfing 

  • Based on availability at time of booking.  
  • Booking redemption period: 18 August 2023 to 27 March 2024. 

 

Lesson purchase validity date: 

  • All lessons are confirmed at time of booking with full payment. 
  • All purchases of Lets Go Surfing lessons, courses and events are valid for 12 months from the actual purchase date. 

Non Transferable: 

  • Lessons and courses are non transferable.  All lessons are purchased & booked for a specific person & cannot be transferred to another person.  

Arriving for your lesson: 

  • All surfers are required to arrive and ‘check-in’ at Lets Go Surfing at least 15 minutes prior to the advised lesson time as per your confirmation advice (Proof of Purchase). Failure to arrive by this time may result in non-admittance to a lesson at Lets Go Surfing’s discretion, without refund. 

 

Customer Cancellation (excludes courses): 

  • If you need to change your booking we are happy to accommodate your preferred time, as long as you give us at least 24 hours notice. Without 24 hours notice the cost of your booking will be forfeited.  
  • If you can no longer make your lesson and you have provided us with at least 24 hours notice you will receive a reschedule or credit. This credit can then be used for a rescheduled lesson at any of our beach locations, surf hire, surf retail, or can be converted into a gift voucher.  

Lets Go Surfing Cancellation:  

  • We surf in all weather and surf conditions providing it is safe.  We do not cancel due to the rain. You are in the water getting wet anyway.  
  • If the surf is too big, or the conditions unsafe, then we will let you know and your lesson will need to be rescheduled. Please contact us to reschedule your lesson. 

Cancellation Policy:  

  • Unfortunately we are unable to refund due to covid misadventure. 
  • We generally do not offer refunds, however, in the event that a lesson has to be cancelled and you cannot attend a rescheduled lesson a credit or refund may be provided.  Refund requests need to be completed via email.  
  • All refunds will incur a 10% bookings & administration fee. 
  • If approved, refunds can take up to 30 days to be processed.  

 

Kiff and Culture 

  • Based on availability at time of booking.  
  • Booking redemption period: 18 August 2023 to 27 March 2024 
  • Tours available Tuesday to Sundays, excluding Saturdays.  
  • In order to secure a booking, full payments or 50% deposits must be made. 

 

Cancellation and Variations 

  • Kiff & Culture (ABN 326 4736 4529 ) (we, us) strives to provide its customers (you) with an enjoyable and safe trip. Occasionally unforeseen circumstances (including adverse weather conditions, mechanical faults, or an insufficient number of passengers for us to run the trip) require us to alter routes, itineraries, vehicle types, fares, days of operation or even cancel tours. We retain the right to do any of these things without notice (however, where practical we will endeavour to provide you with notice of alterations or cancellations). We require a minimum of 4 passengers to run a public trip. If we need to cancel a trip due to there being less than 4 passengers, endeavor to provide you with at least 12 hours’ notice of such cancellation. If our usual venues are booked out, we will endeavour to provide you with alternative venues which can provide a similar offering. Sometimes venues will be booked out due to weddings or other functions even after confirming our booking, whereby we will notify you but provide you with an alternative day or venue. 
  • If Kiff & Culture cancels a trip, we will work with you to book you on a trip on a different date or we will offer a private trip rate. If however you are not able to attend a trip on a different date, we will provide you with a refund of any trip fares already paid. To the extent permitted by law, no refunds will be provided due to alterations to any aspect of the trip. 

 

  • If you cancel a trip booking at least 30 days in advance of the trip, we will provide you with your choice of a refund of any trip fares already paid, or a credit note for a future trip. No refund will be provided for cancellations within 30 days of the trip date, however we will allow you to transfer that trip booking to another date or into another person’s name. A $25 administrative fee will apply to all booking changes within 30 days of departure. 

 

Pick-up and Drop-off Services 

  • You must be waiting at the agreed upon pick-up location at least 10 minutes before the designated pick-up time. It is your responsibility to ensure that you are visible to the Kiff & Culture tour guide. If a Kiff & Culture tour guide is not easily able to locate you at the agreed pick-up location at the agreed pick-up time, we reserve the right to depart without you (and you will be deemed to have cancelled your booking within 7 days of departure and no refund will be given). 
  •  

Minimum Age 

  • We do not accept bookings from passengers under 18 years of age, and by booking a trip with us you represent to us that you are at least 18 years of age. If you’re under 18 years old, you’ll need to be accompanied by an adult. 
  • It is your responsibility to ensure that you are physically fit enough to participate in a trip with us. If you have any questions about fitness levels required, please ask us before you book a trip, because by booking a trip with us you represent to us that you are physically fit and capable of participating in the trip with us, and there are no health-related reasons or problems which preclude your participation in the trip. We highly recommend all passengers have travel insurance coverage. 

 

Kiff and Culture’s Liability 

  • You acknowledge and agree that participation in a trip with Kiff & Culture has inherent risks, dangers, and hazards, and may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that, could cause serious disability, and by booking a trip with us you assume all risks and dangers and all responsibility for any losses and/or damages that may arise during your participation in a trip with us. 
  • At the time that you book a trip, on behalf of yourself, your personal representatives and your heirs, you voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify Kiff & Culture and all its officers, employees and contractors from any and all claims, actions or losses (including those that arise due to Kiff & Culture’s negligence or carelessness) for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of your participation in a trip with Kiff & Culture. 
  • Please note that prior to participating in a trip (including boarding a Kiff & Culture vehicle), Kiff & Culture will require that you sign a written waiver and release of liability. Failure to do so will result in refusal to board and you will be deemed to have cancelled your trip within 7 days of departure (resulting in no refund of trip fees). 

 

Communication and Photography 

  • You agree to allow us to use photographs, quotes and video footage captured on your trip for promotional purposes, within our website and social media platforms. If you don’t wish to have your photograph featured, simply make this clear to us on the day of your tour verbally. Should there be any promotional material used without your consent that you would like removed please inform us so we can take action. All photography is taken in a tasteful, fun manner that we encourage our customers to share and embrace by crediting Kiff & Culture tours. Kiff & Culture retains personal information as permitted by law to resolve disputes and enforce our policies.
